Should a lawyer advise a client in a divorce proceeding to remove information and/or shut down his
facebook account so 'the other side' doesn't find out he has a new significant other? If so, would
that not be destroying evidence? I recently presented at a CLE in Nashville. The consensus of the
attendees was overwhelmingly: YES, the lawyer SHOULD advise his client to destroy it, so long as
there is not a possible criminal investigation....
