In Lucante v. Lucante, the Appellate Division of the Superior Court of New Jersey confirmed the trial court’s order reducing the former husband's child support and alimony obligations based on changed circumstances. The Appellate Division found that the trial judge acted entirely within the bounds of a reasonable exercise of discretion in finding that the former husband’s pursuit of a promotion and an upgrade to his seaman’s license were reasonable under the circumstances, even though the salaried position is less remunerative for the time being than the hourly position that the the former husband held at the time the parties negotiated their Property Settlement Agreement.
This is a favorable decision for those parties seeking to modify alimony and child support.
