On November 9, 2010 lawyers representing the parties in Morgan v. Morgan requested the New Jersey Supreme Court to resolve what standard should apply when a custodial parent requests the Court for permission to move with the children out of New Jersey. The Court has been requested to apply either the best interests of the child standard or principles established by the Court for removal cases a decade ago. The trial judge denied the mother's request to move with the children out of New Jersey. However, the Appellate Division reversed and ruled that the move should be allowed under Baures v. Lewis, 167 N.J. 91 (2001), which held that in a removal case , the requesting parent need only prove a good faith motive and that the move will not be inimical to the child.
