Attorney David Allen reviews a case in which an adult son assists his mother in being admitted to a nursing home. When the son later sues the nursing home for negligence as a result of his mother’s death, the nursing home contends he is bound by an arbitration agreement in the original admission. He argues it was his mother who signed the agreement and he is not bound by it. The US Court of Appeals for the Eighth Circuit decides the case after hearing both arguments.
