In a
divorce or
Suit Affecting the Parent Child Relationship, a
geographical
restriction is often placed on a child to restrict their residence to a specifically
defined geographical area. When determining whether to modify a
geographical
restriction on a child's residence, a court may consider a number of factors, including the
child's relationship with extended family, the presence of friends and a supportive environment, the
financial situation of the parents, and the ability of the noncustodial parent to relocate.
The Court will carefully examine the stated reason for lifting the
geographical
restriction on the child. The parent seeking the change in residence has the burden to
demonstrate how the
modification of conservatorship would benefit the child.
