Happy Valentines Day! Love not only affects the young, it can cause the old to become "twitterpated" as well. A cautionary reality that must be remembered when the elderly get married is that there will likely be significant medical care needs in the near future. Those medical costs need to be paid. When a spouse says "I do", they are saying "I will be responsible for your medical care costs." The Idaho Medicaid system is not bound by the terms of a prenuptial or postnuptial agreement. Medicaid can and will consider the assets, or "resources", of both spouses for qualification and estate recovery.
The good news is, with proper planning, most of the assets of a couple can be protected if one spouse needs to apply for Medicaid assistance. Before applying for Medicaid, or before spending all of your assets paying for care, seek competent legal advice from an elder law attorney!
