Traditionally, the month of January has been the most
popular month by far to begin divorce proceedings.
There are many reasons for this, but one of the biggest is
parents waiting until after the holidays to begin the breakup. Holidays are
supposed to be a happy time for children, and many parents fear tainting
Christmas memories for their children for years into the future. Parents also often
want to give their children one last happy holiday together as a family. In
addition, parents will often give the marriage one more try over the holidays.
In some cases, couples simply don’t want to be alone during Thanksgiving and
Christmas, so they will stay in an unhappy marriage to avoid being alone.

January is that it is typically a time for reflection and following through
with New Year’s resolutions, one of which may be to finally end an unhappy
marriage. Another common reason is that for tax purposes, December 31 is the
day on which it is determined whether or not a couple’s taxes are filed
jointly. Filing jointly is usually more advantageous than filing separately.
